23 лютого 2021 року Північний апеляційний господарський суд задовольнив апеляційну скаргу ПрАТ «А/Т ТЮТЮНОВА КОМПАНІЯ «В.А.Т. – ПРИЛУКИ» на рішення суду першої інстанції та Антимонопольного комітету України про накладання штрафу за нібито порушення законодавства з захисту економічної конкуренції.
Суд апеляційної інстанції уважно дослідив докази і факти у справі і переконався в хибній правовій позиції суду першої інстанції та безпідставності кваліфікацій Антимонопольного комітету України, на чому ми раніше неодноразово наголошували.
Компанія вітає рішення суду апеляційної інстанції. Після більш, ніж року судових дебатів, ми нарешті досягли справедливості у справі і довели свою правоту.

On 23 February 2021 the Northern Commercial Court of Appeal satisfied the appeal of PJSC “A/T B.A.T. – PRILUCKY TOBACCO COMPANY” related to the decision of the court of the first instance and the Antimonopoly Committee of Ukraine on imposition of fine for alleged violation of economic competition laws.
The Court of Appeal has carefully examined the evidence and facts of the case and has found erroneous the legal position of the court of the first instance and groundless the qualifications of the Antimonopoly Committee of Ukraine, on which we have been repeatedly emphasizing.
The company welcomes the decision of the Court of Appeal. After more than a year of judicial debates, we have finally achieved justice in our cause and proved our rightness.
We believe that such decisions, based on a careful analysis of the circumstances of the case and the rules of law, guarantee the stable functioning of the constitutional state in Ukraine and serve as a strong positive signal to investors from around the world who plan to invest into the economy of Ukraine.
